Criminal Procedure Code of the Republic of Kazakhstan

The procedure for criminal proceedings in the territory of the Republic of Kazakhstan is determined by the Constitution of the Republic of Kazakhstan, constitutional laws, Criminal Procedure Code of the Republic of Kazakhstan, based on the Constitution of the Republic of Kazakhstan and the generally recognized principles and norms of international law. Provisions of other laws, governing criminal proceedings, shall be included in this Code.

International contractual and other obligations of the Republic of Kazakhstan, as well as regulatory resolutions of the Constitutional Council and the Supreme Court of the Republic of Kazakhstan, governing the procedure of criminal proceedings, are an integral part of the criminal procedure law.

If in the course of criminal proceedings it is necessary to address the issue that should be resolved in accordance with the civil or administrative law, it shall be resolved in civil or administrative proceedings.
